1. Acceptance of Terms
By accessing or using Orania Eiendomme (hereinafter "the Platform"), you agree to be bound by these Terms of Service. If you do not agree with any of these terms, you must not use the Platform.
2. Services Offered
Orania Eiendomme provides an online platform where:
- Real Estate Agents can list properties for sale or rent
- Private Owners can advertise their own properties (Private Listings)
- Buyers and Renters can search for properties and submit inquiries
We are not a real estate agency and do not act as an intermediary in transactions. All transactions are conducted directly between the property owner/agent and the buyer/renter.
3. Registration and Account
To list properties, you must register an account. You agree to:
- Provide accurate, complete, and current information
- Keep your account credentials confidential
- Notify us immediately of any unauthorized use
- Be responsible for all activities that occur under your account
4. Property Listings
When listing a property, you warrant that:
- You have the right to advertise the property
- All information provided is accurate and true
- Uploaded photos are your property or you have permission to use them
- The property complies with all applicable laws and regulations
We reserve the right to remove any listing that is false, misleading, or violates these terms.
5. Fees and Payments
Orania Eiendomme charges fees for listing properties. The fees are as follows:
- Agents: R150 per month per property
- Private Listings: R250 per month per property
- Featured Listings: Additional R100 per month
All fees are exclusive of VAT. Payments are non-refundable except as required by law. Listings remain active for 30 days after payment, after which renewal is required.
6. User Responsibilities
As a property lister, you are responsible for:
- The accuracy of all property details
- Removing listings immediately when a property is sold or rented
- Responding to inquiries from potential buyers/renters
- Complying with the Consumer Protection Act and other applicable legislation
As a buyer or renter, you acknowledge that:
- You are responsible for inspecting the property
- You are responsible for conducting due diligence
- Orania Eiendomme is not liable for the accuracy of listings
7. Prohibited Activities
You may not use the Platform for:
- Any unlawful purpose or in violation of applicable laws
- Posting false, misleading, or fraudulent information
- Any activity that disrupts the Platform's operation
- Collecting user data without consent
- Promoting discrimination or hate speech
8. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Orania Eiendomme or its licensors and is protected by copyright and other laws. You may not use, copy, or distribute any content without written permission.
9. Limitation of Liability
Orania Eiendomme is provided "as is" without any warranties. To the maximum extent permitted by law, we are not liable for:
- Any direct, indirect, or consequential damages
- Loss of profit or revenue
- Any transactions that occur between users
- The accuracy of property listings
10. Termination
We reserve the right to terminate your account or restrict access to the Platform, without prior notice, if you violate these terms. You may cancel your account at any time by contacting us.
11. Changes to Terms
We may modify these terms from time to time. The date of the last modification will be indicated at the top of the page. Your continued use of the Platform after modifications constitutes acceptance of the modified terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be submitted to the competent courts in South Africa.
